Terms and Conditions

1. Introduction

1.1 These terms and conditions govern the CHOOKS Club operated by CFT Group Marketing Fund Pty Ltd (ACN 119 829 524) ("CHOOKS").

1.2 It is each member's responsibility to read these terms and conditions. These terms and conditions are to be read in conjunction with CHOOKS' privacy policy. A copy of CHOOKS privacy policy may be obtained from CHOOKS' website, http://www.chooks.com.au.

1.3 By registering as a CHOOKS Club member, you acknowledge that you have read these terms and conditions and the CHOOKS privacy policy and agree to be bound by these terms and conditions. If you do not agree with these terms and conditions, you should not register as a member of the CHOOKS Club.

1.4 These terms and conditions are effective as at the date of publication on this website. These terms and conditions, including any rules incorporated in them, may be amended from time to time.

2. Joining CHOOKS Club

2.1 Only individuals may apply to be a CHOOKS Club member and may only hold 1 membership at a time. Companies, partnerships, trusts or other entities are not eligible to register as a CHOOKS Club member. Membership to CHOOKS Club is open to Australian residents only.

2.2 CHOOKS Club membership is subject to acceptance by CHOOKS in its absolute discretion.

2.3 To apply for membership, you must complete all required fields of the membership application. You agree that all information supplied by you to CHOOKS is accurate at the time of its supply. You agree that should any information change, you will advise CHOOKS in writing of that change. You may contact CHOOKS by emailing chooksclub@chooks.com.au.

3. Membership of CHOOKS Club

3.1 It is a condition of the membership that you consent to CHOOKS collecting, using and storing personal information about you in accordance with CHOOKS' privacy policy. By becoming a member, you consent to CHOOKS collecting, using and storing personal information about you in accordance with CHOOKS' privacy policy. You acknowledge that CHOOKS may share your personal information with any of its associates and related companies in accordance with CHOOKS' privacy policy.

3.2 Unless you tell us otherwise, CHOOKS may use your contact details in order to operate the CHOOKS Club and provide to you product information, promotional material, marketing materials, electronic newsletters and advising you of CHOOKS' and any of its associates' and related companies' products, competitions or events which may be of interest. To opt out of receiving these communications you should reply to the unsubscribe link in the email or email CHOOKS at chooksclub@chooks.com.au. You may opt out at any time.

3.3 Membership of the CHOOKS Club may entitle you to receive a number of benefits. These benefits may vary and are at all times subject to availability. CHOOKS reserve the right to change any benefit, product or service without notice.

3.4 Some of the benefits provided by the CHOOKS Club which are offered to the members are provided by suppliers over which CHOOKS has no control. Arrangements for the availability and utilisation of the benefits so offered are made by CHOOKS solely as agent for the suppliers providing such benefits. The provision of the benefits will be subject, in each case, to the terms and conditions of the suppliers providing such benefits and any claims relating to the supply of benefits should be made to the supplier.

3.5 CHOOKS will not be liable for refusal of any supplier of CHOOKS Club benefits to accept or honour the benefit nor will CHOOKS be liable for any loss or damage whatsoever, whether in whole or part, in any way related to any benefits not being offered or honoured.

4. Chooks Club Rules

4.1 The rules listed below are the CHOOKS Club rules ("CHOOKS Club Rules")

4.2 You agree that you may receive benefits from being a CHOOKS Club member and that these benefits are personal to you.

4.3 You agree that you will not abuse any benefits received or conferred on you.

4.4 You agree that you will not abuse any facilities, services or arrangements accorded to you as a CHOOKS Club member.

4.5 You agree that you will not make any defamatory or slanderous statements about CHOOKS, any of its associates and related companies, CHOOKS fresh & tasty franchisees or staff or any of CHOOKS, its associates and related companies products or suppliers.

4.8 You agree that you will not provide to CHOOKS any misleading information.

4.9 Whilst these rules operate as the CHOOKS Club Rules, any specific rules in relation to a CHOOKS Club competition or promotion will prevail over the CHOOKS Club Rules to the extent of any inconsistency between the two.

5. Child Members

5.1 Children under the age of 12 require parental consent to be eligible to be a CHOOKS Club member. If a child applies to be a CHOOKS Club member, their parent or guardian will be asked to provide their consent and contact information. If this consent and contact information is not received, the child cannot be registered as a CHOOKS Club member.

6. Variation to the Terms and Conditions

6.1 CHOOKS reserves the right to vary the terms and conditions of the CHOOKS Club membership at any time without prior notice.

6.2 CHOOKS will use reasonable endeavours to advise members of any changes to these terms and conditions and encourages members to periodically review these terms and conditions.

7. Termination and Withdrawal of Membership

7.1 You may terminate your membership at any time by advising CHOOKS by emailing chooksclub@chooks.com.au.

7.2 CHOOKS reserves the right to withdraw or cancel any membership at any time, without notice at its absolute discretion.

7.3 Without limiting clause 7.2, CHOOKS may terminate a membership if the reasonable opinion of CHOOKS, the member has:

(a) abused any facilities, services or arrangements accorded the member as a result of that member's membership in the CHOOKS Club;

(b) acted in a way which is likely to be detrimental to the interests of CHOOKS, any of its associates and related companies or any of CHOOKS fresh & tasty franchisees or associates; or

7.4 A member's membership automatically terminates upon their death.

7.5 CHOOKS reserves the right to withdraw or cancel the right of any member to use any benefits previously advertised or offered generally to any member and will not be liable for any loss or damage suffered by the member resulting from such withdrawal, cancellation, variation or change.

8. Disclaimer

8.1 CHOOKS does not accept responsibility for any loss or damage suffered by a member, however caused, in connection with that member's use of this website or membership of the CHOOKS Club to the extent permitted by law. CHOOKS offers no warranties in relation to any product information, promotional material or marketing materials supplied to members.

9. Governing Law

9.1 These terms and conditions are governed by and to be construed in accordance with the laws of the State of Western Australia irrespective of where the application for membership has been made or the member resides. You agree to submit to the exclusive jurisdiction of the Courts of Western Australia with respect to any action or proceeding to be instituted or carried on in connection with these terms and conditions.
